I. General terms

  • Terms and Conditions – these terms and conditions.
  • Website – the “BeeClear” website, operating at https://beeclear.pl
  • Service Provider – the owner of the website, a natural person – Marcin Tymek.
  • Service Recipient – any natural person accessing the Website and using the services provided through the Website by the Service Provider.

II. General provisions

  • The Terms and Conditions set out the rules for the operation and use of the Website and define the scope of the rights and obligations of Service Recipients and the Service Provider related to the use of the Website.
  • The subject of the Service Provider’s services is to make available free-of-charge tools in the form of the Website, enabling Service Recipients to access content in the form of posts, articles and audiovisual materials, or web applications and electronic forms.
  • Any content, articles and information containing the characteristics of tips or advice published on the Website are merely a general collection of information and are not directed at individual Service Recipients. The Service Provider is not liable for their use by Service Recipients.
  • The Service Recipient assumes full responsibility for the manner in which materials made available on the Website are used, including their use in accordance with applicable law.
  • The Service Provider does not provide any warranty as to the usefulness of the materials placed on the Website.
  • The Service Provider is not liable for any damages suffered by Service Recipients of the Website or third parties in connection with the use of the Website. All risk associated with the use of the Website, and in particular with the use of information placed on the Website, is borne by the Service Recipient using the Website’s services.

III. Conditions for using the Website

  • Use of the Website by each Service Recipient is free of charge and voluntary.
  • Service Recipients are required to read the Terms and Conditions and the other documents forming an integral part of it, and must accept its provisions in full in order to continue using the Website.
  • Service Recipients may not use any personal data obtained on the Website for marketing purposes.
  • Technical requirements for using the Website:
    • a device with a display capable of displaying websites,
    • an internet connection,
    • any web browser that displays websites in accordance with the standards and provisions of the W3C Consortium and supports websites made available in HTML5,
    • JavaScript support enabled,
    • Cookie support enabled
  • In order to ensure the security of the Service Provider, the Service Recipient and other Service Recipients using the Website, all Service Recipients using the Website should follow the generally accepted rules of network security,
  • The following actions, whether performed personally by Service Recipients or by means of software, are prohibited:
    • decompiling and analyzing the source code without written consent,
    • causing excessive load on the Website’s server without written consent,
    • attempting to detect vulnerabilities in the Website’s security and server configuration without written consent,
    • attempting to upload or inject code, scripts and software onto the server and into the database that could cause damage to the Website’s software, other Service Recipients or the Service Provider,
    • attempting to upload or inject code, scripts and software onto the server and into the database that could track or steal the data of Service Recipients or the Service Provider,
    • taking any action aimed at damaging or blocking the operation of the Website or preventing the fulfillment of the purpose for which the Website operates.
  • If a Cybersecurity incident or a GDPR breach is detected or could potentially occur, Service Recipients should first report this fact to the Service Provider in order to quickly remove the problem/threat and protect the interests of all Service Recipients of the Website.

IV. Collection of data on Service Recipients

In order to properly provide the services offered through the Website, to protect the Service Provider’s legitimate legal interest, and to ensure that the Website’s operation complies with applicable law, the Service Provider, through the Website, collects and processes certain data about Users.

In order to properly provide its services, the Website uses and stores certain anonymous information about the Service Recipient in cookie files.

The scope, purposes, manner and rules of data processing are available in the annexes to the Terms and Conditions: “GDPR Information Obligation” and in the “Privacy Policy“, which form an integral part of the Terms and Conditions.

  • Data collected automatically:
    For the proper operation of the Website and for statistical purposes, we automatically collect certain data about the Service Recipient. This data includes: IP address, Browser type, Screen resolution, Approximate location, Website subpages opened, Time spent on a given subpage of the website, Type of operating system, Address of the previous subpage, Referring page address, Browser language, Internet connection speed, Internet service provider, Anonymous demographic data based on Google Analytics data (Gender, Age, Interests), Anonymous data necessary for serving advertisements (Data related to remarketing, Data related to reporting on displayed advertisements).
  • The above data is obtained through the Google Analytics script and is anonymous.
  • The owner of the Website and the copyright to the website is the Service Provider.
  • Some of the content placed on the Website is protected by copyright belonging to companies, institutions and third parties in no way affiliated with the Service Provider, and is used under licenses obtained, or based on a free license.
  • Pursuant to the Act of 4 February 1994 on Copyright, it is prohibited to use, copy, reproduce in any form, or store in search systems – excluding the Google, Bing, Yahoo, NetSprint, DuckDuckGo, Facebook and LinkedIn search engines – any articles, descriptions, photographs and all other content, graphic, video or audio materials found on the Website without the written consent, or consent given by Electronic Communication, of their legal owner.
  • Pursuant to the Act of 4 February 1994 on Copyright, simple press information, understood as mere information without commentary or evaluation by its author, is not protected. The author understands this as the ability to use information from the texts posted on the website, but not to copy the whole or part of articles unless indicated otherwise in the specific material made available on the Website.

VI. Changes to the Terms and Conditions

  • Any provisions of the Terms and Conditions may be unilaterally changed by the Service Provider at any time, without giving reasons.
  • Changes to the Terms and Conditions take effect immediately upon their publication.
  • Every Service Recipient who continues to use the Website after a change to the Terms and Conditions is deemed to accept it in full.

VII. Final provisions

  • The Service Provider will make every effort to ensure that the Website’s services are offered continuously. However, it is not liable for disruptions caused by force majeure or unauthorized interference by Service Recipients, third parties, or the activity of external automated programs.
  • The Service Provider reserves the right to change any information placed on the Website at a time chosen by the Service Provider, without the need to notify Service Recipients using the Website’s services in advance.
  • The Service Provider reserves the right to temporarily, completely or partially disable the Website for the purpose of improving it, adding services, or carrying out maintenance, without prior notice to Service Recipients.
  • The Service Provider reserves the right to permanently disable the Website, without prior notice to Service Recipients.
  • The Service Provider reserves the right to assign, in part or in whole, any of its rights and obligations related to the Website, without the consent of, or the possibility of any objection by, Service Recipients.
